Application Process
- Submit a completed “Marijuana Special Permit” application with a $350 check made payable to the Town of Lee to the Lee Select Board Office *(any additional fees will be invoiced and must be paid before public hearing date)
- Hearing date will be set within 65 days of the application submission date
- Two public notices will be posted at least 14 days prior to hearing date (this is taken care of by the Select Board Office)
- Hearing will open on scheduled date, and may be continued to a later date if the Select Board chooses to do so
- Hearing is closed
- Decision is made by the Select Board (within 90 days of close of hearing)
- A written decision will be filed within 14 days of the decision.
- Appeal Period – Any appeal must be filed within 20 days of the decision
- Visit the Town Clerk for Business Certification after 20 days has elapsed since the written decision was filed, with or without appeal
- If the Marijuana Special Permit is approved, the Select Board will enter into a Host Community Agreement (HCA) with the marijuana establishment operator
- Substantial Use or Construction must be started within 2 years or permit lapses
