Town of Lee Cannabis Permitting - by Special Permit of the Select Board

Application Process

  1. Submit a completed “Marijuana Special Permit” application with a $350 check made payable to the Town of Lee to the Lee Select Board Office *(any additional fees will be invoiced and must be paid before public hearing date)
  2. Hearing date will be set within 65 days of the application submission date
  3. Two public notices will be posted at least 14 days prior to hearing date (this is taken care of by the Select Board Office)
  4. Hearing will open on scheduled date, and may be continued to a later date if the Select Board chooses to do so
  5. Hearing is closed
  6. Decision is made by the Select Board (within 90 days of close of hearing)
  7. A written decision will be filed within 14 days of the decision.
  8. Appeal Period – Any appeal must be filed within 20 days of the decision
  9. Visit the Town Clerk for Business Certification after 20 days has elapsed since the written decision was filed, with or without appeal
  10. If the Marijuana Special Permit is approved, the Select Board will enter into a Host Community Agreement (HCA) with the marijuana establishment operator
  11. Substantial Use or Construction must be started within 2 years or permit lapses
